“‘It’s more about who owns the history; do they own the history or can we be part owner of the history?’ John Cherwa, APSE’s legal affairs chair told me in a phone interview.”

Is there a more perfect question to ask regarding racing? Unfortunately, the answer now is an unequivocal, “THEY” own the history, and “NO,” we can’t be part owner.

The Leitch piece could have been the postscript of many of the recent failed Triple Crown attempts. Racing seems to be addicted to the bandwagon fans that Leitch is citing as soccer’s holy grail. Racing is also convinced that a holy grail is out there. It’s not and that’s okay.

Exactly. I read that bit in the Leitch piece and thought, how freeing to consider racing that way. We have our moment every spring, it passes, the world goes on.

Teresa, did you part two of the series? I’m always so focused on the law around baseball stats, it was interesting to read about the PGA ruling, which would seem to have some applicability to whatever position Equibase would take in litigation.
